MiCA in the Netherlands requires CASPs to register with DNB by 2025. MistTrack supports compliance with AML tools, risk monitoring, and reporting.

Netherlands MiCA (Markets in Crypto-Assets) Crypto Requirements 2025

The EU's Markets in Crypto-Assets (MiCA) regulation, effective December 30, 2024, mandates that all crypto-asset service providers (CASPs) in the Netherlands obtain authorization from the Dutch Central Bank (De Nederlandsche Bank, DNB) to continue operations. The Netherlands has established a 12-month transitional period during which existing CASPs can operate under current regulations while seeking MiCA authorization.

The Markets in Crypto-Assets (MiCA) regulation introduces a comprehensive framework for CASPs across the European Union, including the Netherlands. Key dates for the Netherlands are as follows:

  • June 30, 2024: Provisions for asset-referenced tokens (ARTs) and e-money tokens (EMTs) become applicable.
  • December 30, 2024: MiCA's full provisions come into effect, requiring CASPs to obtain authorization from the Dutch Central Bank (DNB) to continue operations.
  • December 30, 2025: The Netherlands has established a 12-month transitional period during which existing CASPs can operate under current regulations while seeking MiCA authorization. This period concludes on December 30, 2025, after which only authorized entities may legally provide crypto-asset services.

How MistTrack’s AML Compliance Tools Support Crypto-Asset Service Providers (CASPs) in the Netherlands

Mandatory Licensing

In the Netherlands, CASPs must comply with MiCA’s EU-wide licensing requirements and register with the Dutch Central Bank (DNB) for local operations. MistTrack provides a robust compliance framework, helping CASPs maintain a clear audit trail and meet local regulatory expectations.

Enhanced Due Diligence (CDD)

Dutch AML laws require stringent customer due diligence, aligning with MiCA's standards. MistTrack’s tools enable CASPs to verify wallet screening, assess risk levels, and monitor transactions, ensuring compliance with both DNB’s requirements and EU regulations.

Reporting Obligations

MistTrack simplifies the reporting of suspicious activities to the Financial Intelligence Unit–Netherlands (FIU-NL). Its Suspicious Activity Reporting (SAR) capabilities ensure CASPs meet MiCA obligations while adhering to Dutch reporting standards.

Internal Controls

Dutch CASPs are required to implement robust internal policies under the Money Laundering and Terrorist Financing (Prevention) Act (Wet ter voorkoming van witwassen en financieren van terrorisme, Wwft). MistTrack supports the creation of tailored compliance programs, combining MiCA’s requirements with the Netherlands' specific regulatory needs for effective risk management.

MistTrack provides real-time data analytics and reporting dashboards that meet the high transparency expectations of DNB. This facilitates regulatory supervision and helps Dutch CASPs comply with MiCA’s requirements while maintaining efficient collaboration with national authorities.
